Circulación deportiva de vehículos a motor por terrenos forestales.

 

En los últimos años ha habido un notable incremento en la práctica de determinadas actividades recreativas en el medio natural. Concretamente, en este artículo nos referiremos a la circulación de vehículos a motor –motos, quads, 4x4- en terrenos forestales.

El ocio y disfrute de la naturaleza es una demanda creciente y al alza en la Comunidad de Madrid, que cuenta con más de 6 millones de habitantes. Es fácil comprender, por tanto, que la naturaleza en nuestra región está sometida a una gran presión humana especialmente fines de semana y períodos vacacionales. Por lo que se hace necesario compaginar el disfrute del ciudadano y la protección del medio ambiente, mediante las convenientes herramientas de gestión e información por parte de las administraciones públicas.

De entre las numerosas actividades deportivas o recreativas llevadas a cabo en el medio natural, la conducción de vehículos a motor no plantea problemas cuando se realiza sobre caminos públicos o en circuitos autorizados. Sin embargo, cuando los diferentes tipos de motocicletas y quads circulan por otro tipo de caminos forestales, y especialmente sobre el terreno natural (“campo a través”) pueden producirse serios impactos negativos.

El tránsito de estos vehículos compacta el suelo y destruye la vegetación; si el paso es repetitivo, se originan trochas o rodadas que contribuirán a la erosión del terreno cuando llueva con fuerza, además de degradarse y perder calidad el paisaje. Muchas de estas trochas atraviesan fincas privadas, con el consiguiente perjuicio para sus propietarios. Y por otra parte el ruido de los motores puede molestar a tranquilos paseantes y lo que es peor, a la fauna silvestre, conociéndose casos de fracaso en la cría de especies amenazadas por el tránsito reiterado de este tipo de vehículos.

Los Agentes Forestales y la circulación de vehículos

Con todo ello, existe una extensa legislación que trata de ordenar esta actividad para minimizar su impacto en la naturaleza: Decreto 110/1988 que regula la circulación y práctica de deportes c..., Ley 8/1998 de vías pecuarias en la Comunidad de Madrid, Ley 43/2003 de Montes, etc.

Los Agentes Forestales, como agentes de la autoridad encargados de la vigilancia y protección de la Naturaleza, están capacitados para realizar controles a los vehículos que circulan por el medio natural, y en este sentido conviene tener en cuenta las siguientes observaciones:

- La ley prohíbe circular con este tipo de vehículos a motor directamente sobre terreno forestal, y sobre rodadas preexistentes o fuera de los caminos públicos.

- Por las vías pecuarias de la Comunidad, sólo pueden transitar vehículos ligados al uso agrícola o a la vigilancia ambiental.

- La celebración de competiciones y pruebas debe estar convenientemente autorizada por la administración correspondiente.

- Todos los quads, motos y 4x4 que circulen por el medio natural deben ir matriculados y portar el seguro obligatorio, y sí podrán rodar sobre caminos públicos (salvo señalización en contrario) y circuitos cerrados autorizados.

- En terrenos protegidos (parques, reservas, humedales catalogados...) existen, además de lo señalado, normativas específicas que pueden ser más restrictivas.

En definitiva, la conducción de vehículos a motor en el campo es una actividad en auge hoy día, que sin duda proporciona a quienes la practican un agradable disfrute del deporte y del paisaje. Y su impacto puede minimizarse, siempre que se realice con el máximo respecto hacia el entorno en donde se lleve a cabo.

oday it has approved the new law on mountains of Galicia. Fruit of the AUTT commitment with the current government of the Autonomous Government three years ago and arduous negotiations, there has been a modified wording of Article 54 bis, which removes the legal uncertainty of Article 54 bis of the law of state forests and so instead of banning "generic" circulation, in this case is allowed in a "generic" driving on forest roads.
This great little step, which lasted no less than three years, opens the door to the movement of 4x4 under the current rules of forest law, therefore, we hope to soon pass on the "Galician formula" to other communities .

Artigo 98. Ski forestais
1. Looks like the Law is getting nearer and its so as we can no longer have the fun at the Posito,people are getting stopped by Ceprona and told to leave the area,for that reason the Club will stick to use 4x4 circuits which are available for this reason.

Oh I also agree WILD NATIVE areas should be protected and we should observe tread lightly principals anywhere we go. Leave it as you found it..

Some of our members have had already some experience with the authoraties in this matter,well we are all waiting for an answer from them,hope something is worked out for the next season.There is a platform against this laws which is from were we get this info.
